These Terms and Conditions ("Terms") govern your use of the website at modestoasphaltpavingcompany.com (the "Site") and your engagement with the services provided by Modesto Asphalt Paving Company ("we," "us," or "our").

Modesto Asphalt Paving Company provides asphalt paving, sealcoating, repair, and related contractor services in and around Modesto, CA. The Site provides information about these services and a way to contact us. The Site itself does not constitute an offer or contract for services.
All work is performed subject to a written agreement or accepted estimate between Modesto Asphalt Paving Company and the customer. No work begins until both parties have agreed on scope and pricing.
Estimates provided by Modesto Asphalt Paving Company are based on a visual inspection of the site and information provided by the customer. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
Final pricing may be adjusted if, upon beginning work, conditions are discovered that differ materially from those observed during the estimate - such as unstable base material, hidden damage, or changes in project scope requested by the customer. We will notify the customer of any material price change before proceeding with additional work.
Verbal quotes are not binding. Only written estimates signed or accepted by both parties constitute a price commitment.
Work dates and times are scheduled by mutual agreement. We reserve the right to reschedule jobs due to weather conditions, equipment issues, or other circumstances beyond our control. We will notify the customer as soon as possible in such cases.
If the customer needs to cancel or reschedule, please contact us at least 48 hours in advance. Cancellations made less than 48 hours before a scheduled start may result in a cancellation fee as specified in the written agreement.
The customer is responsible for ensuring the work area is clear of vehicles, equipment, and other obstructions before the crew arrives. Failure to do so may result in a delayed start or rescheduling fee.
Payment terms are specified in the written estimate or agreement. Unless otherwise agreed in writing, payment is due upon completion of the work. Accepted payment methods will be communicated at the time of estimate.
For larger projects, a deposit may be required before work begins. The deposit amount and terms will be stated in the written agreement.
Unpaid balances may be subject to a late payment fee and, if necessary, collection action. The customer agrees to pay all reasonable costs associated with collecting unpaid amounts, including attorney fees, where permitted by law.
We stand behind our work and will address defects caused by our workmanship when reported promptly. Any workmanship warranty will be described in the written agreement for that project.
We do not warrant against damage caused by factors outside our control, including but not limited to: soil movement, ground settling, tree root intrusion, freeze-thaw cycles, flooding, vehicle damage, improper use of the surface, or lack of maintenance by the customer.
The Site and information provided on it are offered "as is" without any warranty of accuracy, completeness, or fitness for a particular purpose.
To the fullest extent permitted by applicable law, Modesto Asphalt Paving Company shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or from any services we provide.
Our total liability for any claim arising from a service project shall not exceed the amount paid by the customer for that specific project.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
You agree to use the Site only for lawful purposes. You may not:

If a dispute arises between you and Modesto Asphalt Paving Company related to these Terms or any services provided, the parties agree to first attempt to resolve the matter informally by contacting us directly. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration or in a court of competent jurisdiction.
You agree to notify us in writing of any dispute before initiating any formal proceedings.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings arising from these Terms shall be brought in a court of competent jurisdiction in California.
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Site or our services after any changes constitutes your acceptance of the updated Terms.
